By placing the Order, the Buyer understands and agrees to be bound by the Terms & Conditions listed below and agrees to pay the price for the Goods that is stated in the Order (the "price). So please read the following very carefully.
Penn Rustics is only able to sell its products to adults, who are able to make their purchase with a credit card or other permitted payment method. If you are under 18, you may purchase from Penn Rustics only with approval of your parent or guardian. None of these Terms & Conditions will affect your statutory rights. No other Terms or changes to the Terms & Conditions will be binding unless agreed in writing signed by us.
Product and Pricing Information
Although Penn Rustics has made every effort to display the products as accurately as possible, the displayed colors of the products will depend upon the monitor of the user and Penn Rustics cannot guarantee that the user's monitor will accurately portray the actual colors of the products. Products displayed may be out-of- stock or discontinued, and prices are subject to change. Penn Rustics is not responsible for typographical errors regarding price or any other matter. Subject to the foregoing, the prices displayed are quoted in U.S. Dollars and are effective only for United States purchases. Purchases are subject to applicable taxes to be paid by the purchaser, and do not include shipping and handling. Purchase requests to addresses outside the United States cannot be filled.
Since all of the products we manufacture are made to order, please allow us roughly a minimum 4-6+ weeks (small orders) or minimum 12-15+ weeks (larger orders) to make and ship your order. Once shipped, we will send you an email confirming shipment and will provide tracking information. Expedited orders are subject to an additional charge.
Nature of Using Wood Products
All of my products are designed and hand made by me in my shop located just outside of Pittsburgh, PA. Penn Rustics only uses real pine wood for all of its products unless specifically noted or requested. I have access to most hardwoods (oak, walnut, etc.), reclaimed wood, and live-edge wood slabs. I prefer to use pine as it keeps costs down for you as my client but am happy to provide quote estimates if you would like one of my products made from something other than pine. Everything starts as raw lumber and is milled and finished according to your order. Items are made to order unless specifically noted. This means that each is made especially for you.
My products are rustic in nature and appearance. The finished product that you receive is my interpretation of what I designed them to look like and are sold "as I produced and designed them". Please keep in mind that due to the nature of handmade items, I CANNOT guarantee perfection on every item you order, but that is what makes them so special and unique. Please respect that each piece is a hand-made and artisanal crafted original - not un-original, mass produced, machine made product.
Each item is unique and no two will be exactly alike. Due to variations in fabric, textiles, wood boards used, the finished product you may receive won't be the exact reproduction of what you see pictured. Stain will absorb into wood differently and the natural knots and marks will only add to the beauty and uniqueness of each item. Wood grains, knots, cracks, and marks are part of the charm of each handcrafted piece. Further, by their nature, wood planks may be somewhat uneven, and may cup, bow, warp, or crack slightly over time, which further enhances their rustic one-of-a-kind character. Given its handmade and hand-finished nature, variations in the wood and materials are to be expected and celebrated.
Variations in size, color and texture are common occurrences in wood and should not be considered a defect. Such features as saw marks, cracks, nail or worm holes, uneven, warped boards, sunspots etc. are what make these tables unique and special. While every precaution will be taken in our finishing process to prevent movement in the wood, splits, cracks, bowing, movement and warping may occur as the wood adjusts to conditions within your home or the environment you place it in.
My pieces are constructed of solid wood it is not uncommon to see shrinkage and expansion or even see small cracks and splits as the seasons change. These potential details should be expected and appreciated. My furniture is made out of a material that was once alive, and it will always have some seasonal movement. Normal problems such as these should not be repaired as they reflect the nature of such an authentically made reproduction. Each piece will grow to have its own personality and will become a unique heirloom your family can appreciate for generations.
I design and build RUSTIC furniture. Natural wood tells a story. You can't hide it's history or the places its been. I consider wood grains, cracks, holes, knots, marks, nicks, scuffs, scratches, etc. part of the charm of each handcrafted piece of rustic furniture that I build. If this does not appeal to you, then you probably won't like my products and would advise you to respectfully shop somewhere else.
Caring For Your Furniture
Characteristics Of Real Solid Wood Furniture:
Penn Rustics provides hand-crafted rustic furniture. Construction is of solid wood taken from North American trees. In both manufacturing and finishing, I try to bring forth the character and beauty of the wood. I prefer and actually seek out wood with strong grains, holes, cracks, knots, marks, nicks, scratches, etc. I consider wood grains, holes, marks, nicks, cracks, scratches, bowing, warping, etc. part of the charm of each handcrafted piece of rustic furniture and product that I build. I go out of my way to find wood that demonstrates these qualities. This is the inherent character of wood and is not considered a defect(s). In working with the lumber, it is expected that there will be variations in the color and grain. These variations are a part of the nature of wood and should not be cause for concern. Our wood will have nail holes, board cupping, cracks, saw marks, worm holes, dents, wood grains, holes, knots, marks, nicks, scuffs, scratches, bowing, warping, etc. These attributes are not considered imperfections or defects in craftsmanship. We consider them character and believe they pay homage to natural solid wood, rustic design and original hand-craftsmanship.
Ultraviolet Light:
Ultraviolet light from the sun and fluorescent fixtures can cause chemical changes in the wood and/or finish. Avoid placing furniture in an area where sun will shine directly on it.
Temperature and Humidity Control:
Wood is a natural fiber. Wood adjusts at different times of the year to the moisture content in the air. Solid wood furniture responds to the changes in temperature and humidity by expanding and contracting. In a sense the wood breathes and will adjust to the moisture content in your home. Extremely dry conditions will have an opening effect in the grain of the wood. A dry home may cause the wood to move or crack more than a home with proper humidity. In a damp environment, it can swell and warp out of shape. Care needs to be exercised to avoid these extremes. Therefore, even furniture like ours with a protective finish will swell or shrink slightly from one season to another. This is most commonly found where the two top surfaces meet on dining tables. Therefore temperature and humidity levels must be controlled. We do our best to make sure each piece of furniture is finished consistently which helps to reduce wood movement, but ultimately we have no control of the environment in your home or where you place your furniture/products and can't be held responsible.
Keep furniture away from direct sources of heating and cooling. Avoid storing furniture in an attic or cellar type environment. Your indoor humidity should be controlled in the range of 35-45% relative humidity and temperature between 60-80 degrees Fahrenheit (this can be measured by a simple household hygrometer and thermometer). Exceeding these levels will cause your solid wood furniture to expand and contract leading to cracking and surface checking. This is not considered defective workmanship. Although Penn Rustics does stand behind our rustic products, we are not responsible for these types of conditions as we have no control of the environment in your home or where you place your furniture/products. The fact is, the larger the solid wood surface (such as a dining table), the more movement and chance of cracking in an uncontrolled environment. When the weather outside is cold the humidity levels are lower, plus most types of heating systems will lower levels as well, especially wood fired heat. A simple humidifier in the winter months can help control your humidity.
Due to temperature fluctuations, you may notice a slab move or develop cracks. These cracks can be easily fixed by placing wood putty/filler in with a plastic putty knife. Some clients prefer to highlight the cracks by dabbing black stain for contrast. Others embrace these changes that reflect the nature of a material that was once alive and enhance the rustic one-of-a-kind character. Given its handmade and hand-finished nature, variations in the wood and materials are to be expected and celebrated.
Keep It Clean:
Immediately wiping up spills and splashes with a moistened cloth obviously keeps furniture clean, but more importantly, you can easily avoid burdensome cleaning and finish abuse by not allowing the spill to set or harden. for most routine hardwood cleaning, a soft cloth with warm soapy water will do the trick. The use of well-formulated cleaning products without abrasives can be effective for those tougher cleaning tasks, but if you use these products, following up with warm, soapy water and a soft cloth will help extensively. Remember that it is important to frequently refold a clean side as the cloth becomes dirty. A soiled, damp cloth can redeposit soil on the finish.
Avoid Dry Dusting & Wiping:
Dust and other normally occurring materials in a house contain tiny abrasive particles, much like fine sandpaper. When removed with a dry cloth they abrade the finish and cause tiny scratches. The result over time is a changed appearance particularly in the most used areas. Prevent this problem by using a dampened soft dusting cloth. The moistened cloth lubricates the surface, picks up dust and holds it so it is less likely to scratch the finish.
Those Easy-Care Products:
Avoid polishes that contain silicone or wax. Use others sparingly, if at all. Your finish does not benefit from them, and they tend to build up a film on the finish that will attract dust and soil making cleaning more difficult.
Lead Time
Due to my current workload, please allow a minimum of 4-6+ weeks for smaller items and 12-15+ weeks for larger furniture items (can be shorter or longer dependent upon our current workload and making everything by hand).
My lead times are estimates, and can fluctuate depending on how many items you order and my current workload. Weekends, holidays, and shipping time is not included in this lead time.
Late Delivery
Due to making everything by hand, any time quoted by Penn Rustics for delivery is an estimate only. Penn Rustics is not liable for or in respect of any loss or damage arising from a delay in filing any order, or delay in delivery. No delay in the shipment or delivery of any order relieves you of your obligations under these Terms, including without limitation payment for your order.

Rush Orders
If you need your order rushed, please email me prior to ordering. I can typically "squeeze" a rush order in but they may not be possible if my current work load is at the maximum threshold. Please contact me to inquire about this upgrade.
Changes To Order
Buyers may, within three (3) business days, make a written request to change their order. Penn Rustics reserves the right to agree or decline any requested changes due to availability of materials or any other reason. If Penn Rustics agrees to make changes, the pricing of the product ordered will be adjusted according to our pricing in place at the time the changes are requested.
Cancellation of Order
A buyer has 24 hours to cancel their order in writing and receive a full refund without penalty. The 24 hours includes Saturday and Sunday. After 24 hours, but no more than 5 business days, it is my discretion if the cancellation will be approved. After this period, Penn Rustics may, in its sole discretion, allow buyer to cancel the order subject to a thirty percent (30%) cancellation fee or refuse to cancel the order.

Inspection
Buyer shall inspect goods upon delivery and notify Penn Rustics within 2 days of receipt ("Inspection Period") if any goods are damaged or incomplete. Buyer will be deemed to have accepted the goods unless buyer notifies Penn Rustics in writing of any damaged or incomplete goods during the inspection period and furnishes such written evidence or other documentation as required by Penn Rustics. If buyer timely notifies us of any damaged or incomplete goods during inspection period, we will work to come to a solution to the problem, if possible. We do not issue refunds for shipping damaged item(s), we only replace the damaged item(s).
Broken, Incorrect, or Defective Produce
If you receive your order and find that some of the items are broken, not what you ordered, or are simply defective (i.e. failed joint, broken leg, etc), please contact us in writing within 48 hours of delivery. Please keep all shipping boxes, shipping materials as these will be needed to file a shipping damage claim (USPS/FedEx/UPS policies, not ours).
Warranties
All items are sold "AS IS" and "AS AVAILABLE." There are no warranties attached or implied to any of our items.

Payment
Penn Rustics requires payment in full before we will begin producing your custom-made order, unless other arrangements are made in writing. Additionally, we will not ship or deliver your order until it is paid in full and consequently all products remain the property of Penn Rustics’ until full payment is received. Down-payments are non-refundable.
We accept Master Card, Visa, American Express, and Discover Card for payment.
All Credit Card transactions conducted through Penn Rustics are handled through third party dedicated gateways for your protection. Penn Rustics will not store your Credit Card information and all card information will be handled with Secure Socket Layer (SSL) encryption. Please read the terms & conditions for the payment gateway chosen for the transaction as they are responsible for the transactions made.
Pricing is applicable as of the day you place your order. Shipping costs and payment fees and total cost will be displayed before you confirm and accept your purchase.
Sales Tax
We require sales tax on all Pennsylvania based purchases. Our shop is located in Pennsylvania so I abide by all tax laws to honor all state taxes. Taxes are not collected for any other state or country, unless specified by law in your state of residence. Any and all applicable sales tax is the responsibility of the customer to report to their respective state of residence. Please note that depending on your region and local customs, local sales tax and customs duty may be incurred with your purchase. Any and all applicable sales tax is the responsibility of the customer to report to their respective state of residence. These charges are the responsibility of the customer to report and pay at their expense.
Return policy
All custom furniture, home goods and wedding products are final sale and not eligible for return. If your product is damaged from delivery you will need to file a claim on the package (all products shipped are insured). We do not issue refunds for damaged items, we only replace the damaged item.
In the odd chance a product is eligible for a return, buyer must request a Return Merchandise Authorization prior to returning the goods, will be required to pay for return shipping, and the order may be subject to a 30% restocking fee. The full amount of the returned goods less shipping and handling costs will be returned to the buyer once Penn Rustics has the goods back in its possession and received back in the same condition received.
We want you to be completely satisfied with your order and we constantly strive to make you happy. If by any chance you are unhappy with your order please contact us and we will do our best to resolve the issue.

Shipping Costs
Unfortunately, due to the high-expense of shipping our products to you, shipping costs are non-refundable after the item has shipped.
No matter what, we want to make sure you are satisfied with your shopping experience at Penn Rustics and we will do our very best to make it happen.
Shipping
All orders are insured and tracking will be provided at no additional cost to the Consumer and we are able to ship anywhere (excluding Post Office Boxes) within the Continental United States! We reserve the right to use a different carrier than those mentioned below if it will result in a cost reduction.
Most small items will usually be shipped via USPS, UPS or FedEx with no signature required. Please note that I do not send our packages "signature required". Sometimes, even though I ship signature not required, the UPS driver has the right to leave a call tag instead of the package if they do not feel comfortable leaving the package. Please be aware that orders only ship on business days; I do not offer weekend or holiday delivery, unless agreed upon in advance. Unless expressly agreed to by the parties in writing, Penn Rustics shall select the method of shipment of, and the carrier for the orders. Penn Rustics may, in its sole discretion, without liability or penalty, make partial shipments of products to you. I will combine and ship multiple items in one box if possible to save shipping costs. All products shipped are insured.

We are located outside of Pittsburgh, PA. Local Pick-ups are always welcome and FREE!

Large Furniture: **Shipping charges are estimated. The cost to ship solid wood furniture from Pittsburgh to Ohio vs Pittsburgh to California are completely different. There may be an additional delivery surcharge dependent on your actual shipping location. Please contact us before ordering for an exact shipping/delivery quote.** Larger items are shipped via UPS or freight depending on size or weight. Delivery is determined by carrier availability.
Small Items: Small packages will be sent via UPS, USPS or FedEx and delivery is *estimated* between 2-5 business days. Tracking IS included and can be monitored daily until arrival. Tracking is emailed to you upon shipment of your order.
Hawaii, Alaska, Puerto Rico and other US Territories:
There may be additional shipping surcharges due to being outside of the contiguous continental US mainland. **Please always check with us before purchasing to inquire about shipping costs.

Receiving Your Freight Shipment
Freight carriers are only contracted to deliver your larger item "curbside". Due to the nature of our furniture (i.e. solid wood), our products can be very heavy. Please make arrangements for help to assist you in getting the furniture inside your home. Please let us know at the time of ordering if you require “White Glove Service”, (bringing the package inside, unpacking it, and setting it up,) so that we can include it in your shipping quote, as this is an additional fee (based upon availability in your area).
The freight carrier will call you, the customer, to set up a delivery time window. In the event of an unsuccessful delivery, the carrier will attempt to reschedule delivery. If rescheduled delivery of package(s) proves unsuccessful, you may be responsible for any return, storage or re-delivery fees associated with the shipment.
Please inspect your items upon delivery. You have the right as the customer to inspect the package and refuse delivery if the item(s) appear to have damage or could be damaged. Once you sign for the delivery receipt, you are accepting all responsibility for the item(s) that they are in good condition.
If there is damage, do not accept and refuse delivery. Please note the damage with the driver so they may file an insurance claim. Please contact us immediately so that we can assist you with this. Please take pictures and keep all packaging as it will be needed during the insurance claims process. Penn Rustics is built on you being a happy customer, therefore, your satisfaction is our primary objective . Please contact us right away if you experience any issues receiving your order.
International Shipping
You will need to request a custom order with your shipping address so we can create a custom shipping quote for you.
If you are located outside the US please be aware that international orders can take 2-8 weeks to arrive (after shipment) depending upon customs. Most orders are shipped the most economical way. If you would like to upgrade to Express Mail please contact us for a shipping quote. All orders shipped outside the US may have duty or tax fees that your country might charge you. These are fees that we cannot quote you for and that we will not be held responsible for. Please purchase accordingly and cautiously - be aware that you might have to pay duty or tax fees upon accepting your order. We charge actual shipping fees ONLY! Again we will not be responsible and will not pay your duty or tax fees. If you order is returned to us for any reason we will not be held responsible and you will be asked to repay the original shipping fees. there are several reasons a package can be returned -- please be very careful to include your proper address, a telephone number you can be reached at, and make sure to respond to any customs notices left for you. If customs tries to contact you or deliver your package and you do not respond or pick it up it will be returned to us and you will have to repay the original shipping fees.

Force Majeure

General Release/Indemnity/Hold Harmless: All Goods purchased are used at the risk of the Buyer. The Buyer understands and acknowledges that the use of the Goods entails both known and unknown risks. Buyer voluntarily and expressly releases, indemnifies, forever discharges and holds harmless Penn Rustics from any and all liability, claims, demands, causes or rights of action which are in any way connected with the use of the Goods.
